South Dakota needs to run smoothly for Elections, Administrative and Business Services for it to thrive.

Voting and the Mailing Issue
On March 31st, President Trump signed an executive order that would disenfranchise more voters. This order also allows the United States Postal Service (USPS) to have voter lists that they should not have, as they are not election officials. The USPS will assign barcodes to each voter. Additionally, they will determine who receives a ballot in absentee voting. If any errors are found in the barcode, the ballots will not be sent.
Two lists will need to be filed. Envelope retention is to be kept for five years, despite federal laws stating that they should be retained for 22 months. These lists will be shared with the Department of Homeland Security (DHS), the Social Security Administration (SSA), and the Immigration and Customs Enforcement (ICE).
Furthermore, election officials are under duress if the federal government takes over elections. The Department of Justice (DOJ) is allowed to arrest election officials even if they follow state laws. The threat of withholding federal funds is a clear form of extortion.

The Problem with the Status Quo
The current Secretary of State’s performance has been severely criticized for failing to fulfill their responsibilities effectively. Notably, they provided the federal government with the voter’s list that had been requested by the Department of Justice under the administration of President Trump. As the administrator, the primary duty of this position is to oversee compliance and identify errors before the federal transmission of voter information. Regrettably, this oversight extended to the registration details of voters, which constitutes a violation of the National Voter Registration Act of 1993.
Furthermore, the Secretary of State failed to comply with the Uniform Commercial Code (UCC) regulations. By neglecting to file the financial statements within the prescribed timeframe, they have imposed an undue burden on businesses, as mandated by law. This situation has a detrimental impact on numerous businesses and serves as a significant obstacle that should not have occurred. Our businesses play a crucial role in driving the economy, both locally and through interstate commerce.
